The meeting was called to order at 6:00 p.m. Present were First Selectman Anthony J. DaRos; Second Selectman Francis W. Walsh and Third Selectman John Opie. Also attending were Joanne Cleary, Tax Collector; Joyce Forte, Human Resources Director; Attorney Courtney Stabnick; Ainsley Highman, Chairman, Parks and Open Space Authority; Anthony Giardiello, RTM Member; Brian Nobile, Nobile Construction; Tracy Knapp, Nobile Construction; Susan Barnes; Jamie Cosgrove; Ann Devlin; Peter Davis; Pam Johnson, The Sound; Diane Stricker, and Peter Davis.
Motion made by Selectman Walsh to approve the minutes of July 15, 2009. Seconded by Selectman Opie. Vote unanimous.
Motion made by Selectman Opie to enter into executive session at 6:02 p.m. with Joyce Forte and Attorney Stabnick to discuss a pending workers compensation claim regarding Michael Modzelewski. Seconded by Selectman Walsh. Vote unanimous.
For the record no votes were taken while in executive session. Present in executive session were First Selectman Anthony J. DaRos; Second Selectman Francis W. Walsh and Third Selectman John Opie. Also attending were Joyce Forte, Human Resources Director and Attorney Courtney Stabnick. Motion made by Selectman Walsh to return to regular meeting at 6:11 p.m. Seconded by Selectman Opie. Vote unanimous.
Motion made by Selectman Walsh to accept the settlement recommendation by Attorney Stabnick in the Modzelewski v. Town of Branford workers compensation case. Seconded by Selectman Opie. Vote unanimous.
Motion made by Selectman Walsh to approve a request from Nobile Construction for the construction of two temporary structures on the town owned sidewalk in front of Towne Pharmacy (1012 Main Street). Seconded by Selectman Opie. Vote unanimous.
Joanne Cleary addressed the Board to provide information concerning the request for the abatement of property tax on the following properties: 302 Thimble Island Road, 4-6 Homestead Place and 628 East Main Street. Motion made by Selectman Walsh to approve the abatement of property taxes for property located at 302 Thimble Island Road. Seconded by Selectman Opie. Vote unanimous. Motion made by Selectman Walsh to approve the abatement of property taxes for property located at 4-6 Homestead Place. Seconded by Opie. Vote unanimous. Motion made by Selectman Walsh to approve the abatement of property taxes for property located at 628 East Main Street. Seconded by Selectman by Opie. Vote unanimous.
Motion made by Selectman Walsh to approve a request from Nancy Cohen, Activity Coordinator, Canoe Brook Senior Center, for an exemption as permitted by section 115-4 of the Code of the Town of Branford regarding the consumption of alcoholic beverages in a public area and allow beer/wine to be served at the following events:
Autumn Dinner Party September 30, 2009
Italian Fest Dinner Party October 28, 2009
Harvest Dinner Party November 19, 2009
Chanukah Dinner Party December 17, 2009
Seconded by Selectman Opie. Vote unanimous.
First Selectman DaRos read the following letters from Wayne Cooke:

First Selectman DaRos stated that there are no documents and will not disclose. The owner will disclose information in September.
Wayne Cooke addressed the Board at 6:31 p.m. He requested that the board adopt his “Zoning Code of Ethics” for Town Hall. Discussion took place regarding Mr. Cooke’s suggestion between the Board members. Motion made by Selectman Walsh to adjourn the meeting at 6:52 p.m. No second. Further discussion took place. Selectman Opie stated that the planning and zoning commission has an obligation to the citizens as well as the developers.
Motion made by Selectman Walsh to adjourn the meeting at 6:54 p.m. Seconded by Selectman Opie. Vote unanimous.
